DEADERRORS is a small, independent clothing label. These terms apply to every order placed through deaderrors.com. By placing an order, you agree to them. You must be 18 or older, or have the permission of a parent or guardian, to place an order. If you have any questions, please contact us before ordering. We are happy to help.
Each design is produced in a run of fewer than 100 pieces. Once a design sells out, it is not restocked, and we may retire a design at any time.
Because each run is small, pieces may vary slightly in color, print placement and fit. These small differences are part of a limited run and are not considered defects. Please review the size chart before ordering.
Some of our designs include images, screenshots, photographs, characters, logos or graphics that we did not create and do not own, including nostalgic imagery from older games, websites and online communities. We use these elements in a spirit of tribute, as part of our own original designs. Our products are not official merchandise of any company or brand.
We do not claim ownership of any third-party imagery. We are not affiliated with, sponsored by, licensed by or endorsed by any artist, photographer, studio, developer, publisher, brand or other rights holder. All trademarks, characters, images and artwork remain the property of their respective owners. Any resemblance is a reference, not an endorsement.
Rights holders. If you believe a design uses your work and would like it removed, please email us with the design name and a description of your work. We will remove the design promptly and will not reprint it. We are committed to acting in good faith and will cooperate with any reasonable request. Please note that a design removed for this reason does not qualify for a refund.
What your purchase includes. Your purchase gives you the item to wear and enjoy. It does not transfer any rights to the images or the design. Items and designs may not be reproduced, resold commercially or used to suggest an affiliation with any brand.
Our own name, logo, product photography and website content are our property. Please do not reproduce them without our written permission.
Prices are listed in US dollars and do not include shipping, applicable Florida sales tax, or any taxes, duties or tariffs charged by your country. Payment is collected in full at checkout through our payment processor. We do not see or store your card details.
Your order is confirmed when you receive our confirmation email. In rare cases we may need to cancel an order before it ships, for example if an item is unavailable, a price was listed in error, or payment cannot be verified. If this happens, you will receive a full refund.
Orders ship within 3 business days of payment. Delivery times are provided by the carrier and are estimates rather than guarantees. We will email you tracking information when it is available.
Please check that your shipping address is correct at checkout. We are unable to replace or refund items sent to an incorrect address provided at checkout, and we are not responsible for carrier delays or customs processing times.
International orders, customs and tariffs. If you order from outside the United States, your country may apply import duties, tariffs, taxes or customs fees when your parcel arrives. These charges are set by your government, are outside our control, and are not included in our prices. They are the responsibility of the buyer. We are unable to cover or refund these charges. If a parcel is refused or returned because these charges were not paid, we are unable to issue a refund.
If tracking shows your parcel as lost, please contact us within 30 days of the ship date and we will assist with a carrier claim.
All sales are final. Because each design is made in such small numbers, we are unable to accept returns or exchanges, or to issue refunds for change of mind, sizing or fit. Please review product details and the size chart carefully before ordering.
Damaged, defective or incorrect items. If your item arrives damaged, defective or different from what you ordered, please email us within 14 days of delivery with a short video showing the issue. We will replace the item or, if a replacement is not available, refund you to your original payment method.
Nothing in these terms limits any consumer rights that cannot be waived under applicable law.
If there is a problem with your order, please contact us first. We resolve most issues within a few business days and would much rather work things out with you directly.
By placing an order, you agree to contact us before initiating a chargeback or payment dispute, and not to dispute a charge for an order that was delivered as described or that falls under the no-refund policy in Section 6. We respond to every dispute with order records, delivery confirmation and a copy of these terms. If a dispute is resolved in our favor, you agree to reimburse any dispute fees we incurred, and we may decline future orders.
Products are sold as is. Except as described in Section 6 and as required by law, we make no warranties about our products, including any warranty of fitness for a particular purpose.
Limitation of liability. To the fullest extent permitted by Florida law, our total liability for any order is limited to the amount you paid for that order. We are not liable for indirect, incidental or consequential losses.
Care. Please follow the care label. We are not responsible for damage caused by washing, drying, altering or misuse.
Governing law and venue. These terms and every order are governed by the laws of the State of Florida. Any dispute will be resolved exclusively in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts.
Jury trial and class action waiver. To the extent permitted by law, you and we each waive the right to a jury trial, and you agree to bring any claim individually rather than as part of a class or representative action.
Time limit for claims. Any claim relating to an order must be brought within one year of the order date.
Indemnification. If your breach of these terms or misuse of our products or designs results in a claim against us, you agree to cover our resulting losses and costs, including reasonable attorneys' fees.
Events beyond our control. We are not responsible for delays or failures caused by circumstances beyond our reasonable control, such as carrier disruptions, supplier shortages, severe weather or government action.
Changes to these terms. We may update these terms from time to time. The version posted at the time of your order applies to that order.
Entire agreement. These terms are the complete agreement between you and us regarding your order. If we do not enforce a provision on one occasion, we may still enforce it later. If any part of these terms is found unenforceable, the rest remains in effect.
